1. Introduction and Acceptance
Welcome to Golf Pool Manager ("we," "our," or "the Service"), operated by 64 Industries. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
Golf Pool Manager is a fantasy sports platform that enables users to create, manage, and participate in golf tournament pools. We are not a gambling service but rather a skill-based competition platform for entertainment purposes.
2. Service Description
Golf Pool Manager provides the following services:
- Online platform for creating and managing golf tournament pools
- Real-time scoring and leaderboard tracking using official PGA Tour data
- Payment processing for entry fees via Stripe
- Automated prize distribution to pool winners
- Commissioner tools for pool administration
- Email notifications for pool activity and updates
The Service is designed for PGA Tour major championships including the Masters Tournament, PGA Championship, U.S. Open, and The Open Championship.
3. User Accounts and Registration
3.1 Eligibility: You must be at least 18 years old to use this Service. By using Golf Pool Manager, you represent and warrant that you are of legal age to form a binding contract.
3.2 Account Types:
- Commissioner: User who creates and manages a pool, collects entry fees, and distributes prizes
- Participant: User who joins a pool, makes golfer selections, and competes for prizes
3.3 Account Information: You agree to provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.
3.4 Account Responsibility: You are solely responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
4. Payment Terms
4.1 Platform Fee: Pool commissioners pay a one-time platform fee of $20 USD per pool (up to 20 participants). This fee is non-refundable once the pool is created.
4.2 Entry Fees: Commissioners may set optional entry fees for pool participants. Entry fees are collected via Stripe and held in escrow until the tournament concludes.
4.3 Payment Processing: All payments are processed through Stripe, Inc. By using our Service, you agree to Stripe's Terms of Service and Privacy Policy. We do not store or have access to your full credit card information.
4.4 Prize Distribution: Winners receive payouts automatically via Stripe after tournament completion. Prize splits are determined by the pool commissioner at pool creation (default: 70% first place, 20% second place, 10% third place).
4.5 Processing Fees: Stripe processing fees (2.9% + $0.30 per transaction) are deducted from the prize pool total. Net proceeds are distributed to winners according to the predetermined prize split.
4.6 Refund Policy:
- Platform fees ($20) are non-refundable once a pool is created
- Entry fees are refundable only if requested before the tournament start date
- If a tournament is cancelled or postponed, entry fees will be held for the rescheduled event or refunded at commissioner discretion

4.7 Taxes: You are responsible for determining and paying any applicable taxes on prizes won through the Service. We may be required to report prize winnings to tax authorities as required by law.
5. Pool Rules and Conduct
5.1 Commissioner Responsibilities:
- Set clear pool rules and communicate them to participants
- Ensure pool complies with local laws and regulations
- Distribute prizes accurately and promptly
- Resolve disputes among participants in good faith
- Do not modify pool settings after participants have made selections
5.2 Participant Obligations:
- Submit golfer selections before tournament deadline
- Pay entry fees (if applicable) before selections are finalized
- Comply with pool format rules (tiered picks, salary cap, etc.)
- Accept commissioner decisions on pool-specific matters
5.3 Scoring Rules: Scoring is based on official PGA Tour results. We use commercially available golf scoring APIs to provide real-time updates. In the event of scoring discrepancies, official PGA Tour final results govern.
5.4 Tie-Breaking: In the event of a tie, prizes are split equally among tied participants unless the commissioner has specified alternative tie-breaking rules.
5.5 Disqualifications: Golfers who withdraw, miss the cut, or are disqualified receive a score equal to the worst performing golfer who completed the tournament, plus a 10-stroke penalty.
6. Prohibited Uses
You agree not to:
- Underage Use: Use the Service if you are under 18 years of age
- Illegal Gambling: Use the Service in jurisdictions where fantasy sports or paid entry competitions are prohibited by law
- Fraud: Create multiple accounts, manipulate scoring, or engage in any form of cheating
- Collusion: Coordinate with other participants to manipulate pool outcomes
- Automated Access: Use bots, scrapers, or automated tools to access the Service
- Harassment: Harass, abuse, or harm other users
- Unauthorized Commercial Use: Resell or commercially exploit the Service without written permission
- System Interference: Attempt to interfere with, compromise, or reverse engineer the Service
Legal Compliance: You are solely responsible for ensuring your use of Golf Pool Manager complies with all applicable federal, state, and local laws. Fantasy sports are legal in 47 U.S. states (excluding Washington and Montana for paid contests). International users must verify compliance with their local regulations.
7. Intellectual Property
7.1 Our Content: All content on Golf Pool Manager, including text, graphics, logos, designs, software, and user interfaces, is the property of 64 Industries or its licensors and is protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
7.3 User Content: By submitting pool names, participant information, or other content to the Service, you grant us a worldwide, royalty-free license to use, display, and process such content solely for the purpose of operating the Service.
7.4 PGA Tour Data: Golf scoring data is sourced from third-party providers and is subject to their respective terms and conditions. PGA Tour, Masters Tournament, and related marks are trademarks of their respective organizations and are used for descriptive purposes only.
7.5 Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.
8. Disclaimers and Limitation of Liability
8.1 "AS IS" Service: GOLF POOL MANAGER IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8.2 No Guarantee of Availability: We do not guarantee that the Service will be uninterrupted, secure, or error-free. Scoring data may be delayed or inaccurate due to third-party API limitations.
8.3 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, 64 INDUSTRIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to use) the Service
- Any conduct or content of third parties on the Service
- Unauthorized access, use, or alteration of your content
- Scoring errors or technical failures
- Disputes between pool participants and commissioners
8.4 Liability Cap: Our total liability to you for all claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months prior to the claim (i.e., the $20 platform fee).
8.5 Assumption of Risk: You acknowledge that participating in paid fantasy sports contests involves risk, including the risk of losing money. You voluntarily assume all such risks.
9. Indemnification
You agree to indemnify, defend, and hold harmless 64 Industries, Golf Pool Manager, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Your violation of any applicable laws or regulations
- Any pool-related disputes with other users
10. Dispute Resolution and Arbitration
10.1 Informal Resolution: In the event of any dispute, claim, or controversy arising from these Terms or the Service, you agree to first contact us at support@golfpoolpro.com to attempt to resolve the matter informally.
10.2 Binding Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Ontario, Canada, or remotely via video conference.
10.3 Class Action Waiver: You agree that disputes will be resolved on an individual basis only, and you waive any right to participate in a class action lawsuit or class-wide arbitration.
10.4 Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
11. Governing Law and Jurisdiction
11.1 Governing Law: These Terms are governed by and construed in accordance with the laws of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict of law principles.
11.2 Jurisdiction: To the extent arbitration does not apply, you agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
11.3 U.S. Users: For users accessing the Service from the United States, additional compliance with applicable U.S. federal and state laws, including the Unlawful Internet Gambling Enforcement Act (UIGEA), is required. Golf Pool Manager operates as a skill-based fantasy sports platform exempt from gambling restrictions in most U.S. states.
12. Termination
12.1 Termination by You: You may stop using the Service at any time. Deleting your account does not entitle you to a refund of platform fees or entry fees for active pools.
12.2 Termination by Us: We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
12.3 Effect of Termination: Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including payment obligations, indemnity, disclaimers, and limitations of liability) will survive.
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the changes taking effect. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
14. General Provisions
14.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Golf Pool Manager regarding the Service.
14.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14.3 Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14.4 Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
14.5 Force Majeure: We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, or failures of third-party services (e.g., Stripe, PGA Tour data providers).
